Terms of Service

These Terms of Service ("Terms") govern your use of Unique Mind Global PTE. LTD.'s customer data infrastructure platform at perspection.app ("Perspection," "we," "us," or "our").

By creating an account, you agree to these Terms. If you don't agree, please don't use our service.

1. What We Provide

Perspection is a customer data infrastructure platform that helps you:

  • Collect website and app events via our SDK

  • Process and deduplicate event data

  • Route events to third-party destinations (Google Analytics 4, Meta Conversions API, TikTok Events API, Google Ads)

  • Analyze customer behavior and attribution

  • Manage data privacy and consent

What We Don't Do

  • Provide legal advice on privacy compliance (consult your attorney)

  • Guarantee 100% accuracy of third-party integrations

  • Store your data forever (retention: 90 days)

  • Replace your analytics platform (we complement existing tools)

2. Your Account

Eligibility

To use Perspection, you must:

  • Be at least 18 years old

  • Represent a legitimate business

  • Provide accurate registration information

  • Have authority to bind your organization to these Terms

Account Security

You're responsible for:

  • Keeping your password and API keys secure

  • Enabling multi-factor authentication (recommended)

  • Notifying us immediately of unauthorized access at info@perspection.app

  • All activity that occurs under your account

3. Acceptable Use

You May

  • Track website and app behavior with proper user consent

  • Collect first-party data for analytics and marketing

  • Route events to authorized destinations

  • Export data to your data warehouse

You May Not

  • Use the service for illegal purposes

  • Collect data without user consent

  • Ignore opt-out requests or Do Not Track signals

  • Transmit malware or harmful code

  • Scrape, reverse engineer, or abuse our API

  • Generate fake events or inflate metrics

  • Access other customers' data

  • Collect data from children under 16

Prohibited Data

Don't send us:

  • Unencrypted credit card numbers

  • Social Security Numbers

  • Health information (without proper agreement)

  • Passwords or authentication credentials

  • Illegal content

If you violate these rules, we may suspend or terminate your account.

4. Pricing and Payment

Subscription Plans

We offer two subscription tiers:

  • Starter Plan

  • Growth Plan

We also offer a 14-day free trial to help you evaluate our service.

Payment Terms

  • Monthly and annual subscriptions available

  • Subscriptions auto-renew unless cancelled

  • Payment due within 7 days of invoice

  • Failed payments result in 7-day grace period, then suspension

  • We use Stripe for payment processing

Overage Charges

If you exceed your plan's limits, you'll be charged for additional usage. Rates vary by plan and charges appear on your next invoice.

Refunds

  • Monthly subscriptions: No refunds

  • Annual subscriptions: Pro-rated refund if cancelled within 30 days

  • We'll refund billing errors when reported within 30 days

Taxes

All prices exclude applicable taxes (VAT, GST, sales tax). You're responsible for taxes based on your billing address.

5. Service Availability

Uptime Target

We aim for high availability but can't guarantee 100% uptime. Service may be interrupted for:

  • Scheduled maintenance (we'll notify you 72 hours in advance)

  • Emergency maintenance

  • Third-party infrastructure issues

  • Force majeure events

  • We respond to support requests as quickly as possible

  • Enterprise customers receive priority support

6. Your Data

Your Ownership

You own all data you send to Perspection. We don't claim any ownership rights to your data.

What We Do With Your Data

We use your data only to:

  • Provide our service

  • Route events to your configured destinations

  • Improve our platform

  • Comply with legal obligations

We don't:

  • Sell your data to third parties

  • Use your data for our own advertising

  • Share your data across different customers

  • Train AI models on your data without permission

Your Responsibilities as Data Controller

For event data from your end users, you're the data controller and we're the processor. This means:

  • You're responsible for obtaining user consent

  • You're responsible for providing privacy notices to your end users

  • You're responsible for responding to user rights requests (GDPR, PDPA)

  • We're responsible for processing data securely according to your instructions

Data Retention

  • Account data: Kept while your account is active, plus 30 days after closure

  • Event data: Stored for 90 days, then automatically deleted (you may request earlier deletion)

  • Backups: Retained for 30 days

7. Privacy and Compliance

Your Responsibilities

As the data controller, you must:

  • Obtain proper consent from your end users

  • Provide clear privacy notices

  • Honor opt-out requests within 48 hours

  • Respond to user rights requests

  • Ensure lawful basis for data collection

  • Not collect data from children under 16 without proper consent

Our Responsibilities

As the data processor, we:

  • Process data according to your instructions

  • Implement appropriate security measures

  • Assist with data subject rights requests

  • Notify you of data breaches within 72 hours

  • Support your compliance efforts

8. Data Security and Location

Security Measures

We protect your data using:

  • Encryption: AES-256 for data at rest, TLS 1.3 for data in transit

  • Hashing: SHA-256 for personally identifiable information

  • Access controls: Role-based permissions and multi-tenant isolation

  • Infrastructure: Google Cloud Platform with SOC 2 Type III certified hosting

  • Monitoring: 24/7 security monitoring and logging

Note: We are working toward SOC 2 Type II certification (planned for 2026) and ISO 27001 certification (planned for 2027).

Data Location

Your data is stored in one of two regions:

  • European Union: europe-west1 (Belgium)

  • Asia Pacific: asia-southeast1 (Singapore)

You select your region during signup. Data stays in your chosen region and is not transferred elsewhere.

Note: United States (us-central1, Iowa) will be added as an additional region option in the future.

9. Intellectual Property

Our Rights

Perspection owns all rights to:

  • The platform, SDK, and API

  • Our technology and algorithms

  • Our trademarks and branding

  • Documentation and content

Your Rights

You retain all rights to:

  • Your company name and branding

  • Data you send to Perspection

  • Your website and applications

License

We grant you a limited, non-exclusive license to use our service according to these Terms. This license ends when your subscription terminates.

10. Warranties and Disclaimers

Our Service "As-Is"

Perspection is provided "as is" without warranties of any kind. We don't guarantee:

  • Uninterrupted or error-free service

  • Specific performance results

  • Third-party integration accuracy

  • Compatibility with all systems

Your Warranties

You warrant that:

  • You have rights to the data you send us

  • Your use complies with applicable laws

  • You've obtained necessary user consents

  • Your information is accurate

11. Limitation of Liability

Important: Please read this section carefully.

Liability Cap

Our total liability to you is limited to the amount you paid in the last 12 months.

Excluded Damages

We're not liable for:

  • Lost profits or revenue

  • Data loss (back up your data)

  • Indirect or consequential damages

  • Third-party destination failures

  • Business interruption

Exceptions

These limitations don't apply to:

  • Our gross negligence or willful misconduct

  • Death or personal injury caused by us

  • Fraud or fraudulent misrepresentation

  • Violations we can't limit by law

12. Termination

You Can Cancel Anytime

  • Cancel through your dashboard settings

  • Email info@perspection.app to request cancellation

  • Cancellation takes effect at end of current billing period

  • Export your data before cancellation (we delete it after 30 days)

We Can Terminate If

  • You violate these Terms

  • You fail to pay

  • We stop offering the service (with 90 days notice)

  • Required by law

What Happens After Termination

  • Your access to the service stops

  • We stop processing your events

  • We retain your data for 30 days (for retrieval)

  • After 30 days, we permanently delete your data

  • You remain responsible for unpaid charges

13. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We'll post the new version at perspection.app/legal/terms

  • We'll update the "Last Updated" date

  • For material changes, we'll email you 30 days in advance

Your continued use after changes take effect means you accept the updated Terms.

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

Informal Resolution

Before filing a legal claim, contact us at info@perspection.app to resolve the issue informally. We'll try to resolve it within 30 days.

Arbitration

For disputes that can't be resolved informally:

  • We both agree to binding arbitration

  • Arbitration will be conducted by a neutral arbitrator in Singapore

  • You may bring claims in small claims court instead

Class Action Waiver

You agree not to bring class action lawsuits. Claims must be brought individually.

15. General Terms

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Perspection.

Severability

If any part of these Terms is found invalid, the rest remains in effect.

No Waiver

Our failure to enforce any right doesn't waive that right.

Assignment

You can't transfer your account without our permission. We can transfer our rights to a successor company.

Force Majeure

We're not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, pandemics, internet outages).
